Poultry Shipping Policy

Buyer Agreement, Purchase constitutes agreements to these terms.

1. Shipping and Deliver

a. Shipping Method: All live poultry orders are shipped via a recognized live-animal carrier (e.g., USPS) using standard live poultry packaging and labeling.

b. Shipment Notification: The Buyer will be notified when the order has been shipped, including tracking information when available. Estimated arrival times are              provided by the carrier and are not guaranteed by the Seller. Tracking tags are available for an additional cost and recommended for long-distance transport.

c. Responsibility at Shipment:
Ownership and all risk of loss for all poultry shall pass to the Buyer upon delivery of the shipment to the carrier by the Seller. Once the poultry is accepted by the carrier, the Seller is not responsible for delays, death, injury, loss, or damage caused during transit or thereafter, including but not limited to mishandling, weather, postal delay, transport damage, inability to reach the Purchaser by the carrier, or incorrect address.

d. Delivery Dates: Dates given for shipment or delivery are approximate only. The Seller shall not be liable for any delay or failure in shipment or delivery resulting from causes beyond its control, including but not limited to natural disasters, equipment failure, postal service delays, or governmental restrictions.

2. Inspection and Claims

a. Arrival Condition: Buyer is responsible for inspecting the shipment immediately upon receipt. Reports of loss, damage, or DOA (dead on arrival) birds must be made within 2 hours of delivery, accompanied by photographic evidence. Please ensure that you are readily available the day of delivery by the carrier to accept your poultry. Live animal shipments are held at the local carrier for pickup.

b. Remedies: At the Seller’s sole discretion, valid claims may be addressed through partial credit or replacement shipment. In no event shall Seller’s liability exceed the purchase price of the affected poultry. Shipping costs are not refundable by the Seller. Carrier claims, if necessary, are the sole responsibility of the Seller.

3. Non-Returnable Item

Due to the nature of live poultry and NPIP requirements, returns are not accepted. All sales are considered final at time of purchase.

4. Limitation of Liability

The Seller shall not be liable for any consequential, incidental, indirect, or special damages, including loss of income, property damage, or reproduction failure caused by the poultry after shipment. The Buyer acknowledges that live animals are subject to stress and environmental factors outside the Seller’s control once in transit.

5. Acceptance of Terms

By placing an order, the Buyer acknowledges and agrees to all terms of this Shipping Policy, including the waiver of Seller’s liability upon transfer of poultry to the carrier.
